29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:   (Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated)  (a)  1201 Market Street, Lemoyne Pennsylvania - The employer did not ensure that employees used a harness and lanyard when in an aerial lift, on or about April 28, 2015.    No abatement certification or documentation required.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  (a) 1201 Market Street, Lemoyne Pennsylvania - Employees used a JLG aerial lift.  The employer did not provide adequate training to employees on hazard recognition and the procedures to follow in order to minimize these hazards, on or about April 28, 2015.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)   (a)  1201 Market Street, Lemoyne Pennsylvania - An employee wore a 3M half mask respirator while working to remove grout from between bricks.  The employer did not develop and implement a written respiratory program when employees were require to wear respirators, on or about April 28, 2015.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
