29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. WORKPLACE: The employer did not instruct employees in the recognition of hazards associated with operating fuel powered equipment, such as (but not limited to) gasoline powered cutoff saw which emitted carbon monoxide (CO) in enclosed spaces or the procedures necessary to eliminate or minimize those hazards.

29 CFR 1926.57(c): "Design and operation." Exhaust fans, jets, ducts, hoods, separators, and all necessary appurtenances, including refuse receptacles, shall be so designed, constructed, maintained and operated as to ensure the required protection by maintaining a volume and velocity of exhaust air sufficient to gather dusts, fumes, vapors, or gases from said equipment or process, and to convey them to suitable points of safe disposal, thereby preventing their dispersion in harmful quantities into the atmosphere where employees work. WORKSITE: The employer did not ensure through providing not only proper and appropriate ventilation equipment, but also specific instructions that the enclosed basement atmosphere where employees were operating a Stihl Model TS 500i gasoline powered cutoff saw to cut out a large opening in a concrete wall in the basement of a building could have not only appropriate air exchanges, but also the harmful gases were vented out to suitable and safe points. On or about April 7, 2015, the harmful gases (carbon monoxide), emitted from the above cutoff saw while performing the above task vented out to an unsuitable points, exposing the employees working in and around the "points" area to carbon monoxide. The employee were taken to a local hospital for carbon monoxide treatment.
