29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use: (Construction Reference 1926.103)  (a) The employer had not established and fully implemented a written respiratory protection program for employees who were required to wear elastomeric cartridge respirators while spray painting, as well as for disposable filtering facepiece respirators used on a voluntary basis.  ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1910.134(k)(6):   The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:    (a) An employee who wore an N95 disposable filtering facepiece respirator on a voluntary basis while performing minor sweeping or walking through areas where painting was being done had not been provided with the basic advisory information on respirators, as presented in Appendix D.  ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1910.1200(h)(3)(iv):   The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information:   (a) As of April 21, 2015, the employer had not trained employees on the new chemical container label elements and the new format and types of information on each section of safety data sheets (SDSs). Employees were potentially exposed to such hazardous chemicals as acrylic paint.  ABATEMENT CERTIFICATION IS REQUIRED
