29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    WORKSITE: The employees, re-pointing the chimney from a roof bracket scaffold and crawling board (chicken ladder) were not protected from the hazard of falling 10 feet to the ground by the use of personal fall arrest or equivalent fall protection systems.

Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  WORKSITE: The employees re-pointing the chimney from the 5/12 pitched garage roof were not protected from the hazard of falling 9 feet 6 inches to the ground by the use of personal fall arrest or equivalent fall protection systems.

29 CFR 1926.1053(b)(7): Ladders shall not be used on slippery surfaces unless secured or provided with slip-resistant feet to prevent accidental displacement. Slip-resistant feet shall not be used as a substitute for care in placing, lashing, or holding a ladder that is used upon slippery surfaces including, but not limited to, flat metal or concrete surfaces that are constructed so they cannot be prevented from becoming slippery.    WORKSITE: The Werner Model D6016-2 16-foot fiberglass extension ladder, which was used by employees to access the roof and missing slip-resistant feet was placed on the slippery surface of the stamped concrete driveway without being appropriately secured to prevent from displacement.    On or about April 24, 2015, the above ladder was displaced while an employee was using to access the roof, and the employee fell approximately 8 feet onto the driveway and sustained serious head injuries from fall.
