29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: a) At the facility, where the employer did not implement a noise monitoring program for employees that are exposed to noise over 85 decibels. An employee was exposed to 145.4% of the noise dose which is equivalent to approximately 92.7 decibels. The employee was sampled for approximately 312 minutes during one work shift. Zero exposure was assumed for the unsampled time of 168 minutes.
