OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling from a distance greater than four feet: Plant: A vehicle-mounted aerial platform with visibly leaking hydraulic fluid which affected the operation of the equipment was not repaired prior to use as required by the Operating Manual in accordance with ANSI A 92.6-1990, Section 8.4. Two of many methods that can be used to correct the hazard are mentioned below: 01. Establish a pre-start inspection program as required by the manual. 02. Remove the aerial platform from service if any problems or malfunctions affect the safe operation of the equipment until the problems or malfunctions are corrected. DISACLAIMER: a. The employer is not limited to the abatement methods suggested by OSHA. b. The employer is responsible for selecting and implementing an effective abatement method.
