29 CFR 1910.269(l)(3)(iii): The employer did not ensure that no employee approaches or takes any conductive object closer to exposed energized parts than the employer's established minimum approach distance, unless: (A) The employee was insulated from the energized part or (B) The energized part was insulated from the employee and from any other conductive object at a different potential, or (C) The employee was insulated from any other exposed conductive object in accordance with the requirements for live-line barehand work in paragraph (q)(3) of this section. This violation occurred on or about April 27, 2015, in the area near Wingard Rd. in Shiro, TX where an employee was shocked electrically while approaching a 14.4Kv downed power line without maintaining a minimum approach distance. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that the employee is insulated from the energized part or the energized part is insulated from the employee and from any other conductive object at a different potential or the employee is insulated from any other exposed conductive object in accordance with the requirements for live-line barehand work in paragraph (q)(3) of this section.
