29 CFR 1926.453(b)(2)(v): A body belt was not worn and a lanyard attached to the boom or basket when working from an aerial lift:     a)         Front of house, center, 966 Barnagat Ln:    An employee with a fall arrest harness was not attached to the boom or basket while working from the Model 4527 A Bil-Jax aerial lift installing trim approximately 24 feet above ground level, on or about 04/29/2015;    b)         Front of house, center, 966 Barnagat Ln:    An employee was not attached to the boom or basket while using the Model 4527 A Bil-Jax aerial lift while accessing the approximately 30 feet high wall bracket scaffold near the peak of the roof, on or about 04/29/2015.      Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    a)    Front of house working below the peak; 966 Barnagat Ln:    The wall bracket scaffold, approximately 30 above ground level, did not have any fall protection at the ends of the platform while employees were working from it to install trim, on or about 04/29/15;    b)    Front of house working below the peak; 966 Barnagat Ln:  The aluminum pump jack scaffold with the platform setup approximately 18 feet above ground level did not have any fall protection at the ends of the platform while an employee was working from it to install trim, on or about 04/29/15.      NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.      Schuler Roofing, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 315281535, citation number 01, item number 002f and was affirmed as a final order on 08/02/2011, with respect to a workplace located on Jersey Avenue  Spring Lake, NJ 07762 .
