29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.    a.  On or about April 29, 2015 - at the above addressed jobsite, an employee was working on the chimney from a tubular welded frame scaffold which was not designed by a qualified person, thereby exposing the employees to falls.

29 CFR 1926.451(c)(1): Supported scaffolds with a height to base width (including outrigger supports, if used) ratio of more than four to one (4:1) shall be restrained from tipping by guying, tying, bracing, or equivalent means, as follows:  a.  On or about April 29, 2015 - at the above addressed jobsite, an employee was working on a chimney from a tubular welded frame scaffold with a height to base width ratio greater than four to one (>4:1) that was not restrained from tipping, thereby exposing employees to falls.

29 CFR 1926.452(c)(3): Frames and panels shall be joined together vertically by coupling or stacking pins or equivalent means.  a.  On or about April 29, 2015 - at the above addressed jobsite, an employee was working on a chimney from a tubular welded frame scaffold, approximately thirty two (32) feet six (6) inches above the ground, which had frames that were not joined together vertically by the use of stacking pins, thereby exposing employee to the hazards associated with scaffolding collapse.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as used as a means of access.    a.  On or about April 29, 2015 - at the above addressed jobsite, an employee working on a chimney from a tubular welded frame scaffold approximately thirty two (32) feet six (6) inches above the ground was not provided with safe access to the scaffold, thereby exposing the employee to falls.

Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.  a.  On or about April 29, 2015, at the above addressed jobsite, an employee working on a chimney from a tubular welded frame scaffold, approximately thirty two (32) feet six (6) inches above the ground, was exposed to injuries from a fall due to the lack of guardrails.

The training shall include the following areas, as applicable:    a.  On of about April 29, 2015 - at the above addresses jobsite, an employee working from the tubular welded frame scaffold was not trained to recognize the hazards associated with scaffolding, thereby exposing the employee to the hazards associated with falls.
