OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from a fall hazard while changing florescent lighting tubes using a inadequate work platform on the forks of a Crown RC3000 stand up forklift.  On or about March 30, 2015, in the Warehouse, an employee was exposed to a 15 ft. fall hazard while standing in an inadequately constructed platform on the forks of a Crown RC3000 stand up forklift to change florescent lighting tubes in their fixtures.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(l)(1)(ii): Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).  The Company had not ensured that two employees working in the Warehouse were trained as required by paragraph (l) prior to operating a Crown stand up RC3000 forklift.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1904.29(b)(3): How quickly must each injury or illness be recorded? You must enter each recordable injury or illness on the OSHA 300 Log and 301 Incident Report within seven (7) calendar days of receiving information that a recordable injury or illness has occurred.  An employee injury that occurred on December 29, 2014 and determined recordable due to the medical treatment of sutures involving on a laceration while cutting plastic banding was not recorded on the OSHA 300 Log for 2014.

29 CFR 1910.1200(f)(5)(ii): Appropriate hazard warnings, or alternatively, words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  In the Assembly, Quality Assurance Area, the employer had not labeled a secondary container spray bottle of Formula 409 used by an employee to clean registers with the appropriate hazard warnings.
