29 CFR 1926.601(b)(3): Motor vehicle was not equipped with an adequate audible warning device in operable condition at the operator's station: (a). Worksite located at 1335 W. Highway 76, Branson, Missouri- Employer was operating a dump truck in which the driver would back down and around the west and north sides of the building and the vehicle was not equipped with a functional audible warning device. Employees were exposed to struck-by injuries which in this instance, resulted in the death of one employee. Abatement certification for this violation is not required.

29 CFR 1926.601(b)(4): The employer had in use motor vehicle equipment having an obstructed view to the rear which did not have a reverse signal alarm audible above the surrounding noise level or an observer signaling it was safe to back up the vehicle: (a). Worksite located at 1335 W. Highway 76, Branson, Missouri- The employer was backing a dump-truck with an obstructed view and the truck did not have an functioning audible alarm and there was not an observer present to signal to the operator that it was safe to back the vehicle. Employees were exposed to struck-by injuries which in this instance, resulted in the death of one employee. Abatement certification for this violation is not required.
