29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    a)    Edge of roof above PetValu:    Employee without fall protection approximately 14 feet above the sidewalk at the edge of the overhang was throwing concrete blocks over the edge into the trash bin below, on or about 04/30/15.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:    a)    740 West Route 70, Marlton, NJ 08053, rooftop:  The Werner 22 foot Type 1A Telescoping MultiLadder used by the employee to access the approximately 14 foot high overhang was not secured at its top to prevent it from slipping when used (bottom of ladder was within approximately 6 inches of the curb), on or about 04/30/2015.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1060(b): The employer did not provide retraining as necessary for each employee using ladders and stairways so that the employee maintained the understanding and knowledge acquired through prior training:    a)    740 West Route 70, Marlton, NJ 08053: Employee had not been retrained in proper setup and use of the  Werner MT-22 22 foot Type 1A Telescoping MultiLadder to get onto and off of the overhang approximately 14 feet above the concrete sidewalk, on or about 04/30/2015.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
