29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) On or about April 30, 2015, R. J. Corman Railroad Construction, LLC exposed employees to struck-by hazards when an operator in training was permitted to operate a boom truck. A competent person did not inspect the area for predictable hazards such as striking other employee occupied equipment. The boom truck was not inspected for proper set up by a competent person. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.1417(a): The employer did not comply with all manufacturer procedures applicable to the operational functions of equipment, including its use with attachments. a) On or about April 30, 2015, R. J. Corman Railroad Construction, LLC did not comply with the manufacturer procedure of ensuring the crane operator read and understood the operator's manual as required by the operator's manual and decal 316113 located at the operator's station. b) On or about April 30, 2015, R. J. Corman Railroad Construction, LLC did not comply with the manufacturer procedure of ensuring the crane stabilizers were lowered to provide a level stable platform as required by the operator's manual and decal 316105 located at the operator's station. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.1417(c)(1): The procedures applicable to the operation of the equipment, including rated capacities (load charts), recommended operating speeds, special hazard warnings, instructions, and operator's manual, were not readily available in the cab at all times for use by the operator. On or about April 30, 2015, R. J. Corman Railroad Construction, LLC did not make readily available the manufacturer's operator's manual for use by the operator. The operator's manual provides information for the safe operation of the crane. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.1427(k)(2)(i): The employer did not ensure that operators of equipment covered by this standard were competent to operate the equipment safely: On or about April 30, 2015, R. J. Corman Railroad Construction, LLC exposed employees to struck-by hazards when an employee operated a boom truck in an employee occupied area of the job site. The employer had not evaluated the employee operator to ensure the equipment could be operated safely. The employee operator had no previous experience with the accident involved boom truck. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
