29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  On or about April 30, 2015 at the above addressed worksite, employees performing chipping operation using a Chicago Pneumatic CP117 heavy duty zip gun hammer were not provided with eye protection, exposing them to flying projectiles and silica dust that can result in corneal abrasions and lacerations to the eye.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer:  (Construction Reference 1926.103)  On or about April 30, 2015 at the above addressed worksite, employer did not provide employees that voluntarily wearing 3M 8210 N95 filtering facepiece with the information contained in Appendix D of 29 CFR 1910.134.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)   On or about April 30, 2015 at the above addressed worksite, the employer did not develop or implement a written hazard communication program describing hazardous chemicals, such as, but not limited to, Stucco Portland cement and silica dust, for employees performing chipping and remodeling operation.
