29 CFR 1910.266(d)(1)(ii): The employer shall assure that personal protective equipment, including any personal protective equipment provided by an employee, is inspected before initial use during each workshift. Defects or damage shall be repaired or the unserviceable personal protective equipment shall be replaced before work is commenced. a) On or about April 19, 2015, an employee was injured when his equipment failed. The employer did not ensure that the tree climbing spurs that were provided and used by employees, were serviceable, and not defective, thereby exposing employee(s) to a near fall hazard and a struck-by hazard.

29 CFR 1910.266(d)(1)(i): The employer shall assure that personal protective equipment, including any personal protective equipment provided by an employee, is maintained in a serviceable condition. a) On or about April 19, 2015, the employer did not ensure that employees, that were performing tree trimming removal work, were provided proper personal protective equipment such as, but not limited to safety glasses, hard hats, gloves and/or hearing protection.

After an employee hospitalization as a result of a work-related incident on or about April 19, 2015, the employer did not report the in-patient hospitalization to OSHA.
