OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush-by hazards.     Employees were exposed to crush-by hazards while operating a Toyotas forklift truck without wearing a seat belt.      (a) At least one (1) employee was operating a forklift in the milk shipping department;  (b) At least one (1) employee was operating a forklift without a seat belt in the K-Stock department.      One feasible method to correct the hazard includes, but is not limited to: enforce the use of seat belts while operating the forklift.

OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish to each of his employees employment and a place of employment which were free from recognized struck-by hazards that were causing or likely to cause death or serious physical harm to his employees:    Employees working in the milk shipping department were exposed to struck-by from falling objects by the following:      (a) Racking systems cross bars,  support legs and/or support bar damaged;     (b) Racking systems not anchored to the ground;    (c) Racking system did not have plaques containing the maximum permissible unit load and/or maximum uniformly distributed load per level, and/or the racking system did not have the maximum total load per bay.      One feasible and acceptable means of abatement is to perform routine inspections to identify those conditions that require repair and/or replacement of missing or damaged parts in accordance with ANSI Standard and Commentary MH16.1-2012 (Specification for the Design, Testing, and Utilization of Industrial Steel Storage Racks) and RMI Specifications.

29 CFR 1910.24(f):  All treads were not reasonably slip-resistant and the nosings were not of nonslip finish.  Welded bar grating treads without nosings are acceptable providing the leading edge can be readily identified by personnel descending the stairway and provided the tread is serrated or is of definite nonslip design.  Rise height and tread width were not uniform throughout any flight of stairs including any foundation structure used as one or more treads of the stairs:    (a)  Outside the production area metal treads were loose and rusted    (b)  Outside the break room area two (2) flights of metal treads were rusted

29 CFR 1910.178 (q)(1):  Any power-operated Industrial trucks not in safe operating condition were not removed from service.  All repairs were not made by authorized personnel:      (a) K-Stock area, light does not work on the Toyota, model, 8FGCU25, serial no. 63883, type LP, Toyota, model, BFCGU25, serial no. 40845, type P, and Toyota, model, BFCGU25, serial no. 40845, type P;       (b) In the milk shipping department, bay area # 8 and #10, employees were using a Toyota forklift that did not have a plate for model no. or serial no. identification.  The horn and the lights did not work;      (c) Outside the building, Toyota forklift, model, BFGU32, serial no. 35942, type LP tires were worn and not in good condition.
