29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:    (a) Front side, new townhome construction located on Lot #44 Naramore Lane, Johns Creek, GA 30022: Employee was exposed to overhead struck-by hazards while working directly below shingle bundles being hoisted to the roof while operating a TranzSporter (Model LH-200) Material Hoist without a protective helmet.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access:    (a) Front side, new townhome construction located at Lot #44 Naramore Lane, Johns Creek, GA 30022: Employees were exposed to falls of approximately 20-feet, 8-inches to the lower level while accessing a ladder which was not extended at least 3-feet past the eave or secured to the structure to allow employees safe access on and off the roof.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    (a) Roof, new townhome construction located at Lot#45 Naramore Lane, Johns Creek, GA 30022: Employees were exposed to eye injuries while operating Hitachi (Model - NV45AB2) Coil Roofing Nail Guns at 120 PSI with no protective eyewear.     Jose Manuel Alvarado-Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 993468, citation number 1, item number 1 and was affirmed as a final order on 10/16/2014 , with respect to a workplace located at Regency Oaks Atlanta, GA 30349.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    (a) Roof, new townhome construction located on Lot #44 & #45 Naramore Lane, Johns Creek, GA 30022: Employees were exposed to fall hazards of approximately 20-feet, 8-inches to the lower level while engaged in residential roofing activities on a 8/12 pitched roof with no fall protection system in place.      Jose Manuel Alvarado-Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 993468, citation number 1, item number 2 and was affirmed as a final order on 10/16/2014, with respect to a workplace located at Regency Oaks, Atlanta, GA 30349.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired:  (a) Front side, new townhome construction located at Lot #44 Naramore Lane, Johns Creek, GA 30022: The ladder provided to access the roof was damaged and missing components. Ladder rungs were bent and at the base of the ladder there was missing feet. The ladder was not inspected or tagged and removed from service.
