29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a.   On or about April 20 2015 on the northeast side of a new construction commercial building, employees installing rafters to a pergolas were not protected from an 8 feet 4 inch fall hazard by the use of a personal fall protection system.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step:  a.   On or about April 20 2015 on the northeast side of a new construction commercial building, an employee used the top step of a step ladder to remove himself from the top of a pergolas, exposing the employee to a 8 feet 4 inch fall hazard.
