29 CFR 1910.23(e)(2): Stair rails did not consist of a top rail, intermediate rail and/or posts, with the vertical height not more than 34 inches (86.36 cm) nor less than 30 inches (76.2 cm) from upper surface of top rail to surface of tread in line with face of riser at forward edge of tread:    (a) Upstairs in the fleet maintenance shop, where employees were using offices and storing truck parts, the stair rail height measured at least 37 inches and the intermediate rail was not positioned approximately halfway between the top rail and riser forward edge, resulting in an opening of at least 20 inches between the top rail and intermediate rail, exposing employees to the hazards of falling as far as 10 feet to the concrete floor.     (b) Diesel fueling area in the batch plant yard, where employee(s) were using stairs to access the tank platform for gauging fuel levels in tanks, there was an opening of 30 inches between the top rail and riser leading edge due to lack of an intermediate rail, exposing employees to the hazards of falling as far as 13 feet to the ground.
