29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: On May 7, 2015: Noise sampling of employees working in the Press Shop was conducted. The employees are exposed to an occupational noise level at or above the 8-hour time weighted average of 85 decibels while working on Press #6, performing handwork and deburring operations. The employer had not administered a hearing conservation program. (a) Employee #1, Sample #222156 - TWA 89.6 decibels, monitored for 449 minutes (b) Employee #2, Sample #222157 - TWA 88.4 decibels, monitored for 445 minutes

29 CFR 1910.134(c)(2)(i): Respirator users were not provided with the information contained in Appendix D to 29 CFR 1910.134 when the employer determined that any voluntary respirator use was permissible: On or about May 5, 2015: Employees working in the Press Shop wear the N95 filtering face piece respirator voluntarily when grinding or deburring small parts. The employer did not provide the employees with information in Appendix D of the respiratory protection standard.
