29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a. At the work site, two supervisory employees used a fork lift to primarily load and unload golf cars but occasionally to move equipment, parts and supplies. The employer had a fork lift training program but had not trained employees.

29 CFR 1910.1200(h)(2)(iii): The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets required by this section. a. At the work site, employees who performed repairs, maintenance and customization on golf cars used a variety of chemicals that included (but were not limited to) Americhem Multi-Purpose Solvent A-1011, US Battery acid, Lucas Heavy Duty Oil Stabilizer, Spectrum Corporation Silicone Lubricant, gasoline, Bulldog Adhesions Promoter, Power steering fluid and Rust-oleum spray paints in a variety of colors. The employer did not have a written Hazard Communication Program or a list of hazardous chemicals used at the work site.
