Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about May 5, 2015, at the worksite located at 1106 Main Street in Vilonia, Arkansas, east side of the building, employees elevated in a personnel basket attached to the forks of a telescoping handler on a Case 688G rough terrain forklift, did not wear fall protection while engaged in gutter installation trim work activities. This condition exposed employees to tip-over and falls from elevation.

29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use: On or about May 5, 2014, at the worksite located at 1106 Main Street in Vilonia, Arkansas, east side of building, employees worked from an elevated personnel basket attached to the forks of a telescoping handler on a Case 688G rough terrain forklift to perform gutter installation activities. manufacturer's approval was not obtained to ensure the personnel basket was compatible for use with the forklift.
