OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were potentially exposed to struck-by hazards from compressed gas cylinders that were not firmly secured and/or prevented from tipping/falling over: A.) Connecto Electric, Inc., 220 Peninsula Drive, Erie, PA 16505, second floor of food stand building, on or about May 7, 2015 and times prior thereto: Employees were performing electrical installation activities including, but not limited to, installing overhead lighting fixtures. Employees were exposed to a potential stuck-by hazard from four unsecured carbon dioxide cylinders that were free standing in the work area.

29 CFR 1926.405(b)(2): All pull boxes, junction boxes, and fittings were not provided with covers: A.) Connecto Electric, Inc., 220 Peninsula Drive, Erie, PA 16505, wave pool building electrical room, on or about May 7, 2015 and times prior thereto: Employees were performing work activities included, but not limited to, pulling low voltage wiring from the emergency stop buttons for the wave pool to the control cabinet, and wiring an electrical receptacle. An electrical junction box above the wave pool building electrical room door contained energized electrical wires, and was not equipped with a cover plate.
