29 CFR 1910.178(o)(2): Load(s) were being handled which exceeded the rated capacity of the industrial truck(s): a) On or about May 4, 2015, the Toyota forklift model 8FGU25, serial #41971 with a maximum capacity of 4650 lbs. was overloaded with a load of 5000 lbs. exposing the employee to getting struck if the forklift tips over. b) On or about May 4, 2015, the Moffett forklift model M70, serial #M240028 with a maximum capacity of 3000 lbs. with the forks extended, was overloaded with a load 5000 lbs. exposing the employee to getting struck if the forklift tips over.

29 CFR 1910.178(l)(3)(i)(H): The employer did not evaluate employees knowledge and/or understanding of the powered industrial truck capacity and/or capability: On or about May 14, 2015, the driver of the Moffett forklift had not been trained on the capacity of the forklift in it's different configurations, exposing the employee to getting struck if the forklift tips over.
