29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition was not taken out of service, and/or repairs were not made by authorized personnel: a) On or about 05/08/2015, the employer did not take the Linde E20B electric forklift out of service while it was in an unsafe operating condition due to the truck's damaged and inoperable operator restraint system (seatbelt). Employees operating the Linde E20B would be exposed to caught between hazards in a tip-over event.
