OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a) 2101 Hwy 27, Geneva Hwy, Enterprise AL; The employer exposed employees to struck-by and fall hazards from the potential collapse of an aerial lift boom that was not inspected and maintained in accordance with the manufacturer's requirements and industry standard (ANSI A92.2-1969 or 1979). On or about May 8, 2015 an employee operating a Hi-Ranger aerial lift, (Model #5HA-55PBI) was exposed to fatal injuries from blunt force trauma when the boom of the aerial lift failed while elevated.

29 CFR 1910.135(a)(1): The employer did not ensure that each affected employee wear a protective helmet when working in areas where there is a potential for injury to the head from falling objects: a) 2101 Hwy 27, Geneva Hwy, Enterprise AL; On or about May 8, 2015 and at times prior thereto the employer exposed employees to potential head injuries in that the employer did not ensure employees working under or near a tree topping operation wore a protective helmet when there was potential for injury to the head from falling and flying objects.
