29 CFR 1926.300(a): All hand and power tools and similar equipment, whether furnished by the employer or the employee, shall be maintained in a safe condition. Employees performing floor sanding operations were exposed to struck by hazards while utilizing a commercial grade sander with a broken power switch that could only be de-energized by disconnecting it from the receptacle. The employer did not ensure the employee's power tools were maintained in a safe condition. Abatement certification is required of this item in accordance with requirements of 29 CFR 1903.19(c).
