29 CFR 1926.651(f): A warning system such as barricades, hand or mechanical signals, or stop logs was not utilized when mobile equipment was operated adjacent to an excavation, when such equipment was required to approach the edge of an excavation, and the operator does not have a clear and direct view of the edge of the excavation, a warning system shall be utilized.  LOCATION; 579 Van Buren Street, North West corner of project.  On or About January 15, 2014   a)Employee was operating a Bobcat type front end loader and was moving dirt to backfill against the exposed foundation. There was warning system or stop log being used and the bobcat fell into the excavation.

29 CFR 1926.706(a)(3): The limited access zone for masonry construction was not established on the side of the wall which was un-scaffolded:  LOCATIONS: 579 VanBuren Street, Brooklyn, NY, West end of project.  On or about January 15, 2015.  A). Employees working to backfill the foundation and excavation were exposed to potential struck by and caught in hazards because there was no limited access zone around the 6 foot tall masonry block wall being erected at the west side of the project.
