29 CFR 1926.95(a): Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact.   On or about May 13, 2015, at the jobsite located at 6730 NW 106th Ave, Miami FL 33178, the employer did not provide the appropriate well-fitting gloves (butyl or nitrile) to the employees who were wearing loose-fitting rubber latex yellow gloves when using wet cement in the plastering operations.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix)  with worksite specific procedures was not established and implemented for required respirator use (Construction Reference 1926.103):  On or about May 13, 2015, at the jobsite located at 6730 NW 106th Ave, Miami FL 33178, the employer did not established a written respiratory program with worksite specific procedures for employees mixing Stucco Cement and exposed, but not limited to silica, and required to wear tight fitting (filtering facepiece) respirators following the recommendation established on the manufacturer' s SDS.
