OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees who operate hydraulic automotive lifts are exposed to struck-by hazards in that automotive lifts can descend without notice. (a) The employer did not ensure that automotive lifts were functioning in a way so as not to unexpectedly descend when employees are using the lifts to perform various vehicular repair and maintenance. Lifts #1, # 2, and # 5 have known mechanical issues.
