29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: Jobsite located at 701 N. Pennsylvania Ave., Independence, KS 67301: employees using the portable metal extension ladder to access the roof were exposed to fall hazards of up to 13 feet 3 inches from the ladder to the brick/concrete below in that the side rails of the ladder did not extend at least 3 feet above the landing surface of the roof. The side rails extended approximately 18 inches.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards: Jobsite located at 701 N. Pennsylvania Ave., Independence, KS 67301; employees had not been adequately trained to recognize and minimize hazards associated with ladders. Employees did not recognize and take steps to correct the portable metal extension ladder which was improperly set up and used with the side rails extended less than 3 feet above the landing surface of the roof.
