29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated: a) American Turf Recycling, LLC - Elyria, Ohio: On or about September 21, 2016, the employer did not submit verification of abatement certification for citation 1, item 1a for inspection number 1063416, which became a final order on June 26, 2016. The employer did not submit documentation indicating that forklifts are safe for use, and preshift inspections of the forklifts are being conducted. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck was not taken out of service until it was restored to safe operating condition. a. American Turf Recycling, LLC located in Elyria, Ohio: On or about May 19, 2015, the employer did not ensure the Nissan forklift used to move materials in the production area was removed from service when the headlights were found to be nonfunctional. b. American Turf Recycling, LLC located in Elyria, Ohio: On or about May 19, 2015, the employer did not ensure the Caterpillar forklift used to move materials in the production area was removed from service when the headlights and parking brake were found to be nonfunctional. American Turf Recycling, LLC was previously cited under a different company name, Ohio Polymers and Recycling, Inc., for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178 (p)(1), which was contained in OSHA inspection number 966948, citation number 1, item number 4a and was affirmed as a final order on June 23 2015, with respect to a workplace located at 860 Taylor St., Elyria, OH 44035.
