Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to equipment roll over. On June 24, 2015, at 17820 Ridge Drive in Carlinville, Illinois, an employee was exposed to equipment roll over hazards when operating a John Deere Z930M zero turn commercial mower on an approximately 14 degree slope terrain. The employee was not using a seat belt while the roll over protection structure (ROPS) was in use. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition is to follow the manufactures operations manual and require and ensure the use of seat belts when using roll over protection structure (ROPS) in an upright position.
