29 CFR 1926.602(a)(9)(ii): Earth moving or compacting equipment which had an obstructed view to the rear was operated in reverse gear; such equipment did not have in operation a reverse signal alarm distinguishable from the surrounding noise level or did an employee signaled that it is safe to do so. (a) 671 Main Street, Paterson, NJ: A Deere 160 LC excavator did not have an operational back-up alarm, on or about 5/20/2015. Advantage Construction and Excavating Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.602(a)(9)(ii) which was contained in OSHA inspection number 1040831, citation number 1, item number 1 and was affirmed as a final order on 5/11/2015, with respect to a workplace located at 661-671 Main Street, Paterson, NJ 07503.
