29 CFR 1910.178(l)(1)(i):   The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l)  (Construction Reference 1926.602):  a)  1100 Frank E. Rodgers Blvd., Harrison, NJ and at the Corporate Offices at 92 Garden Street, 1st Floor, Newark, NJ.  The operator of the Sky Trak 10054 rough terrain forklift had not received the training and evaluation required in the powered industrial truck regulation.                                              Violation observed on or about 05/09/2015.

29 CFR 1926.501(b)(1):   Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a)  1100 Frank E. Rodgers Blvd., Harrison, NJ.  Workers were exposed to falls of 10 to 21 feet to the wood and concrete decks below as fall protection methods were not adequate.                                             Violation observed on or about 05/09/2015.

29 CFR 1926.503(a)(1):   The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  a)  1100 Frank E. Rodgers Blvd., Harrison, NJ and at the Corporate Offices at 92 Garden Street, 1st Floor, Newark, NJ.  This employer had not provided for a training program for each employee who was exposed to fall hazards which may have helped them to prevent being exposed to falls of 10 to 21 feet to the wood and concrete decks. Employee was exposed to falls of approximately 16 feet to concrete deck below as he was working from the top step of the 6 foot stepladder which was placed at the edge of the wood deck.                                              Violation observed on or about 05/09/2015.
