29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:    (a) Horix Machines: Employees were exposed to amputation hazards as lockout tagout procedures were not being utilized for the control of potentially hazardous energy when employees were engaged in unjamming and cleaning the Horix Flofil Rotary Filler Machines on Line A (also known as Line 3), B (also known as Line 2), and Line C (also known as Line 1).    On or about May 13, 2015, a temporary employee received crushing injuries to their fingers and multiple injuries to their arm when cleaning a Horix Flofil Rotary Filling Machine on Line C (also known as Line 1) and lockout tagout was not utilized.

29 CFR 1910.147(c)(4)(ii): Procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A), (c)(4)(ii)(B), (c)(4)(ii)(C) and (c)(4)(ii)(D):    (a)  Through out facility: Employees were exposed to amputation hazards as there were no machine specific lockout tagout procedures for machines that were hard wired in, such as, but not limited to, the Horix Flofil Rotary Fillers Line A (also known as Line 3), Horix Flofil Rotary Filler Line B (also known as Line 2), and Horix Flofil Rotary Filler Line C (otherwise known as Line 1), which had electrical, and pneumatic power sources.

29 CFR 1910.147(c)(7)(i)(A): Authorized employee(s) did not receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control:  (a) Building 7, Horix Filling Machines Lines A, B, and C:  Employees and Temporary employees were exposed to amputation hazards when unjamming and cleaning Horix machines on Lines A (also known as Line 3), Line B (also known as Line 2) and Line C (also known as line 1), were exposed to amputation hazards as they were not trained as authorized employees to perform lockout tagout of equipment.  On or about May 13, 2015 a temporary employee received multiple injuries to fingers, and arm when cleaning the Horix Flofil Rotary Filling machine Line C (also known as line 1).

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been  taken out of service until restored to safe operating condition(s):  (a) Building 7: Employees were exposed to struck by hazards as the Clark C25C Forklift # 25 powered industrial truck which did not have a nonskid surface for the brake pedal and it was not taken out of service.  (b) Building 7:  Employees were exposed to struck by hazards as powered industrial truck # 10,  the tires had wear, the lights were not working, and a cylinder was leaking and it was not taken out of service until maintenance was performed.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:  (a)  Building 7, Horix Flofil Rotary Filler Machines:  Employees were exposed to amputation hazards as the three Horix Flofil Rotary Filler Machines, Line A (or Line 3), Line B (or Line 2), and Line C (Line 1),  did not have fixed or interlocked guards to protect the operator and other employees in the area to hazards from point of operation and ingoing nip points.  On the three Horix Flofil Rotary Filler Machines there were no fixed guards for ingoing nippoints at the back of the machine from the gears in the center piece, the rotating carousel by the skirting, the moving shelves, the pinch points between the solid platform and the plates that the jugs are on.    On or about May 13, 2015 a temporary employee received crushing injuries to their fingers, and multiple injuries to their arm when caught in the Horix Flofil Rotary Filler Machine Line C (also known as Line 1).
