29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees due to an amputation or loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA. At the accident site, located at 10713 Straw Flower Drive, Austin TX, an employee fell approximately 13 feet or more through the sheet rock ceiling of a residence under construction, sustaining hip and shoulder injuries that required hospitalization of 4 to 5 days. The employee was inspecting the attic for access to attic windows that would need to be cleaned on 14 May 2015, Thursday. The employer did not report the hospitalization within 24 hours; instead, calling the hospitalization in approximately 4 days later on 18 May 2015, Monday.
