OSH ACT of 1970 Section (5)(a)(1): the employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee who rode an excavator bucket out of a trench was exposed to fall and struck-by hazards: On or about May 19, 2015, at 1500 W. Causeway Approach, Mandeville, LA, the employer allowed an employee to ride the bucket of a Bobcat E42 excavator to egress a 6 foot 7 inch deep excavation. The employee was exposed to fall and struck-by hazards from the bucket in the event of an inadvertent movement and/or operation.
