OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from being struck by a skid steer loader performing construction debris cleanup.   On or about 18 May 2015, and at times prior thereto, a general laborer was working near a Bobcat Skid Steer Loader, Model S590, with a grapple bucket attachment, placing construction debris into the bucket when the grapples activated and closed down upon the employee, impaling him in the back with one of the claws at a depth of approximately 4 inches, requiring hospitalization of more than 4 days.
