29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system. a)400 Kings Hwy East, Middletown, NJ: On or about 5/20/2015, employees of Classic Rock Masonry were conducting basement waterproofing. The employees were excavating an approximately 5-6 foot deep trench adjacent to the basement wall. The excavation was not protected from cave-ins by an adequate protective system and as such collapsed, trapping a worker in waist deep soil.

The employees were excavating an approximately 5-6 foot deep trench adjacent to the basement wall. The spoils pile was directly adjacent to the excavation and was not contained to prevent rolling or falling into the trench, creating potential struck-by and crushing hazards to the employees.

The employees were excavating an approximately 5-6 foot deep trench adjacent to the basement wall. The excavation was not protected from cave-ins by an adequate protective system. The spoils pile was located directly adjacent to the excavation. Inspections of excavation and the adjacent areas were not made by a competent person for evidence of a situation that could have resulted in a possible cave-in and as such, the trench collapsed, trapping a worker in waist deep soil.
