OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to an amputation or serious injuries while operating a DeWalt DWS 780 Compound Miter Saw:  On or about May14, 2015, an employee of Andre Portillo was exposed to an amputation hazard while operating the miter saw to cut floor planks; which the staples were not removed prior to cutting.    Among other means, one feasible and acceptable abatement method to correct these hazards is: Utilize the DeWalt Instruction Manual - Safety Rules for Miter Saws which states never cut ferrous metals.   Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.403(i)(2)(i): Live parts of electric equipment operating at 50 volts or more were not guarded against accidental contact by cabinets or other forms of enclosures, nor by any of the means listed in subparagraphs (A) through (D) of this paragraph.   a) On or about May 14, 2015; first floor front room; the energized electrical panel was not properly guarded.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupters for personal protection.  a) On or about May 14, 2015; first floor of the building, employees were operating electrical equipment such as but not limited to portable circular saws that were not plugged into a ground fault circuit interrupter.

29 CFR 1926.405(b)(2): In energized installations, each outlet box did not have a cover, faceplate, or fixture canopy:     a) On or about May 14, 2015; first floor; the electrical outlets were missing the face plates where the outlets were used to provide power to portable equipment that included but was not limited to a radio, exposing employees to a shock hazard.
