29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. At the time of the inspection on or about 19 May 2015 at a residential roofing construction site located at 327 Turnberry Place Drive, Wildwood, MO, four (4) employees of the general contractor/Bella Construction LLC, were working on a 20 foot high roof top with an 8/12 pitch roof conducting a tear off, without any means of fall protection in place. The owner of Bella Construction LLC, stated that she had been onsite that morning to drop off the trailer used to collect debris. Having been on the worksite that morning she was familiar with the hazards that employees would have been exposed to such as fall hazards and proper use of PFAS, but failed to communicate those hazards accordingly. The employer did not have a site specific or general written safety and health program at the time of the inspection and had not conducted any means of jobsite hazard identification or communicated it to her employees.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. At the time of the inspection, on or about 19 May 2015 at a residential roofing construction site located at 327 Turnberry Place Drive, Wildwood, MO, 4 employees of Bella Construction LLC, were working on an 8/12 pitch roof conducting a tear off of roofing materials on the garage and the home, without any means of fall protection in place.
