29 CFR 1910.66(i)(1)(v): The employer shall certify that employees have been trained in operating and inspecting a working platform by preparing a certification record which includes the identity of the person trained, the signature of the employer or the person who conducted the training and the date that training was completed. The certification record shall be prepared at the completion of the training required in paragraph (i)(1)(ii) of this section, and shall be maintained in a file for the duration of the employee's employment. The certification record shall be kept readily available for review by the Assistant Secretary of Labor or the Assistant Secretary's representative. On or about 05/13/2015, the employer did not certify that the maintenance custodians who were required to use a Lift-A-Loft scissor lift, Model/No. SP 20-710, Serial/No. PU 3032 and a Lift-A-Loft, VERITA lift, Model/No. VAL 2911during cleaning operations of paper dust that had accumulated on overhead surfaces.

29 CFR 1910.134(k)(6): The basic advisory information on respirators, as presented in Appendix D of this section, shall be provided by the employer in any written or oral format, to employees who wear respirators when such use is not required by this section or by the employer. On or about 05/18/2015, custodian workers who wore N95 Respirators while performing high-bay cleaning were not provided the information contained in Appendix D of 29 CFR 1910.134.
