29 CFR 1910.178(l): Operators were not trained in the safe operation of powered industrial trucks and as referenced by the note contained in 29 CFR 1926.602(d):   a) Telehandler:  On or about May 14, 2015, the employer did not ensure the person that operated the forklift had received training to recognize and avoid unsafe operations which exposed employees to fall hazards.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  a) Telehandler: On or about May 14, 2015, the employer did not ensure an employee required to work from a job made wooden platform being supported by the forks of the telehandler was provided the required training which exposed the employee to forklift related hazards.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  a) Telehandler: On or about May 14, 2015, the employer allowed personnel to be elevated in a job made wooden personnel platform with the telehandler while not using fall protection which exposed employees to falls up to 34-feet.

29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were  made without the manufacturer's written approval:  a) Telehandler: On or about May 14, 2015, the employer allowed the use of a job-made wooden platform to elevate personnel which exposed employees to fall hazards.   Note:  If such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals should have been changed accordingly.
