29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:  a) Telehandler: On or about May 14, 2015, the employer allowed the use of a job made wooden platform supported on the forks of the telehandler prior to providing training on the requirements which exposed an employee to falls up to 30-feet.    b) Telehandler: On or about May 14, 2015, the employer allowed the use of a prefabricated metal platform supported on the forks of the telehandler prior to providing training on the requirements which exposed an employee to falls up to 30-feet.

29 CFR 1926.451(a)(6): Scaffolds were not designed by a qualified person:  a) Telehandler: On or about May 14, 2015, the employer did not ensure the job made wooden platform supported on the forks and used to elevate personnel was designed by someone who, by possession of a recognized degree, certificate, or professional standing, or who by extensive knowledge, training, and experience, has successfully demonstrated the ability to solve or resolve problems related to the scaffolding systems which exposed employees to scaffolding hazards.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section:  a) Telehandler: On or about May 15, 2015, the employer allowed the person being elevated in a job made wooden platform supported on the forks to attach his person fall arrest system to the webbing of a tie down strap, used to secure the platform to the telehandler's backrest, which exposed the employee to falls up to 30-feet to the ground below.

29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were  made without the manufacturer's written approval:  a) Telehandler: On or about May 14, 2015, the employer did not seek or obtain the manufacturer's written approval and updated documentation prior to allowing the use of a job-made wooden personnel platform with the telehandler which exposed employees to forklift related hazards.  b) Telehandler: On or about May 14, 2015 and prior thereto, the employer did not seek or obtain the manufacturer's written approval and updated documentation prior to allowing the use of a metal personnel platform with the telehandler which exposed employees to forklift related hazards.
