OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a struck-by hazard. a. On or about May 26, 2015, located at Martins Ferry Rail Yard, employees operated a 15,000 pound capacity Electrolift underhung crane, serial number 20178 without performing an inspection of the upper limit switch prior to use, thereby exposing the employees to a struck-by hazard if two-blocking occurred resulting in wire rope failure.

29 CFR 1910.23(c)(3): Regardless of height, open-sided floors, walkways, platforms, or runways above or adjacent to dangerous equipment, pickling or galvanizing tanks, degreasing units, and similar hazards shall be guarded with a standard railing and toe board. a. On or about May 26, 2015, located at Martins Ferry Rail Yard, employees manually shoveled aggregate into open conveyor pits while the conveyor belts were moving, thereby exposing the employees to a fall into dangerous equipment and a caught-between hazard.

29 CFR 1910.243(b)(1): Tool retainer. A tool retainer shall be installed on each piece of utilization equipment which, without such a retainer, may eject the tool. a. On or about May 23, 2015, located at Martins Ferry Rail Yard, employees operated an Atlas Copco, model number XAS 185 portable air compressor in order to supply air for cleaning. The hoses that were used in part to supply the air did not have a means to retain the hose at the air compressor, hose connection point and at the blow-off hose.
