29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents   a)302 Lippincott Dr., Marlton, NJ: On or about 05/27/2015 an Adriano DaSilva employee was conducting sheathing activities on the roof of a new construction wood framed commercial structure.  The employee was using a circular saw to cut plywood and was not using face or eye protection and was thus exposed to potential struck-by hazards from flying wood chips.     NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   a)302 Lippincott Dr., Marlton, NJ: On or about 05/27/2015 an Adriano DaSilva employee was conducting sheathing activities on the roof of a new construction wood framed commercial structure.  The employee wearing a fall harness but was not secured to any safety line, exposing him to a fall hazard of approximately 9 feet from the roof to the ground below.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards.  a)302 Lippincott Dr., Marlton, NJ: On or about 05/27/2015 an Adriano DaSilva employee was conducting sheathing activities on the roof of a new construction wood framed commercial structure.  The employee wearing a fall harness but was not secured to any safety line, exposing him to a fall hazard of approximately 9 feet from the roof to the ground below.  The employer had not trained employees exposed to fall hazards to recognize the hazards as well as the procedures to minimize these hazards.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.1053(b)(1): Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet above the upper landing surface to which the ladder was used to gain access:     a)302 Lippincott Dr., Marlton, NJ: On or about 05/27/2015 an Adriano DaSilva employee was conducting sheathing activities on the roof of a new construction wood framed commercial structure.  The rails of the ladder the employee used to access the roof extended less than 1 1/2 feet above the upper landing surface, exposing the employee to potential fall hazards.    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The rungs of the ladder the employee used to access the roof were damaged and dented.  The ladder was not immediately marked " Defective, Do not Use" and withdrawn from service.   NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
