29 CFR 1910.252(b)(2)(iii): Workers and other persons adjacent to the welding area were not protected from the rays by noncombustible or flameproof screens or shields: The employer does not ensure that workers and other persons adjacent to the welding area are protected from the rays by noncombustible or flameproof screens or shields. This violation was observed on or about May 27, 2015 in the shop where the employer had several welding stations but only one welding screen. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that workers and other persons adjacent to the welding area are protected.

The employer did not ensure that employees were provided a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. This violation was observed on or about May 27, 2015, in the shop where employees were not medically evaluated before being required to use a respirator in the workplace. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employee(s) are medically evaluated before being required to use a respirator.
