29 CFR 1926.451(h)(2)(ii): A toeboard shall be erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below, except on float (ship) scaffolds where an edging of 3/4 x 1 1/2 inch (2 x 4 cm) wood or equivalent may be used in lieu of toeboards;  (a) The employer did not ensure that each employee working under scaffolding was protected from struck by hazards created by falling objects by installing toe boards on platforms more than 10 feet above the ground below.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface shall be used.  Crossbraces shall not be used as a means of access.  (a) The employer did not ensure proper access to the scaffolding platform that was more than (2) two feet above or below a point of access for employees thereby exposing them to fall hazards.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  (a) The employer did not ensure that scaffolds were erected, moved, or dismantled only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling this exposed employees to a possible scaffold collapse or other hazards due to scaffolding erection, moving, or dismantling not being done correctly.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. (vi) Each employee performing overhand bricklaying operations from a supported scaffold shall be protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).  (a) The employer did not ensure that each employee had been protected from fall hazards from falling to a lower level while working on scaffolding that was greater than 10 feet high by the use of a personal fall arrest system or guardrail system.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  (a) The employer did not ensure each employee who performs work while on a scaffold was trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards thereby exposing those employees to fall and struck by hazards.
