29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard(s) in the workplace; including a reasonable estimate of employee exposures to respiratory hazards and identification of the contaminant's chemical state and physical form: (Construction Reference 1926.103): (a) Entrance: On or about May 28th, 2015 and at times prior, employees were exposed to respiratory hazards while installing new electrical systems in and around the dry cutting of sandstone with a gas powered portable chop saw. (b) Loading Dock: On or about May 28th, 2015 and at times prior, employees were exposed to respiratory hazards while installing new electrical systems in and around the dry cutting of cinder blocks and brick with an MK 5000 block chop saw with a non-functioning water pump. (c) Entrance: On or about May 28th, 2015 and at times prior, as the controlling employer, Swank Enterprises Inc., did not ensure its sub-contractor, Stearns Masonry, Inc., protected their employees in that employees were exposed to respiratory hazards while installing new electrical systems in and around the dry cutting of sandstone with a gas powered portable chop saw. (d) Loading Dock: On or about May 28th, 2015 and at times prior, as the controlling employer, Swank Enterprises Inc., did not ensure its sub-contractor, Stearns Masonry, Inc., protected their employees in that employees were exposed to respiratory hazards while installing new electrical systems in and around the dry cutting of cinder blocks and brick with an MK 5000 block chop saw with a non-functioning water pump.
